Rules to remember when vaping in public!

These days, electronic cigarettes are becoming massively popular. It's been over 10 years now since vape first appeared in France. According to one study, there are now almost 3 million vapoteurs in France.

With the development of this smoking cessation method, numerous regulations and bans have been put in place and reinforced by the health law enacted in 2016.

The vapoteur is not free to use his electronic cigarette in all places.

However, is it allowed at work?

This question is the subject of debate between supporters and opponents of vape. Some argue that vaping in public places, such as the workplace, is not a nuisance because the smoke is not harmful, while others are opposed and don't want e-cigarettes to be used near them.

The legislator of the 2016 health law is formal: "E-cigarette users may not vape in closed and covered workplaces for collective use".

In this context, if the employee does not comply with this rule, he or she may be exposed to sanctions from his or her employer.

There are limits to this predisposition. For example, an employee who has his or her own enclosed workspace can legally vapourize. However, this will depend on the employer's internal regulations.

And what about public places... ?

In public places, the rules depend on Article L3513-6 of the 2016 Health Law. Not all public places are affected by this ban. The legislation stipulates that e-cigarette users may not vape in "educational establishments, intended for the reception, accommodation of minors". In addition to enclosed public transport (streetcar, bus, metro, train), which are also affected by this ban.

As far as bars and restaurants are concerned, vaping is possible provided that the store manager does not include any prohibition in his or her internal regulations.

So before you start vaping, it's always a good idea to check that it's legal in the place in question.
